DHS subpoenas tech firms to unmask anti-ICE accounts
The Department of Homeland Security has reportedly issued hundreds of administrative subpoenas to major tech platforms to identify anonymous users criticizing the agency.
The Department of Homeland Security has reportedly been increasing pressure on tech companies to identify the owners of social media accounts that criticize Immigration and Customs Enforcement (ICE). According to reporting by The New York Times, the department has sent hundreds of administrative subpoenas seeking to unmask anti-ICE accounts to major platforms, including Google, Reddit, Discord, and Meta. This practice of demanding user data, which was previously used sparingly by federal authorities, has reportedly become increasingly common in recent months. The subpoenas reportedly focused on accounts that did not have a real name attached and either criticized ICE or described the location of ICE agents.
According to reporting by the Washington Post, the Department of Homeland Security uses administrative subpoenas — which do not require the approval of a judge — to target Americans. The scope of these actions includes at least five cases reported by Bloomberg, in which the Department of Homeland Security sought to identify the owners of anonymous Instagram accounts. In those five cases, the department withdrew its subpoenas after the account owners filed lawsuits to protect their identities and block the unmasking.
The tech companies receiving these requests have responded in various ways. Google, Meta, and Reddit have reportedly complied with the administrative subpoenas in at least some cases. Echoing past comments, Google has stated that it informs users of these subpoenas when it can, and the company maintains that it pushes back when it determines that the subpoenas are “overbroad.”
